We would like to inform you that by using the Bartools.hu website and webshop, you as a customer (consumer) declare that you know and accept the following, Ptk. (Act V of 2013) General Terms and Conditions written on the basis of §§ 6:77-6:81. If you wish to be a customer or an active user of the options offered by our online store, please read our General Terms and Conditions carefully and use our services only if you agree with all of their points and consider them binding on you.

This document is concluded exclusively in electronic form. The contract regulated by the following conditions is the Civil Code. is considered a contract concluded between persons who are absent.

In these general terms and conditions, the service provider (ZBS Kft.) is hereinafter referred to as: Service Provider.

2. Range of products and services available for purchase

On the Bartools.hu website, products from the following product groups can be purchased:

Warning: The images displayed on the product data sheet may differ from the real thing, in some cases they are only shown as illustrations.


3. Order information

The displayed products can be ordered online, by e-mail and by phone through the Webstore, with home delivery by courier or personal collection by the customer or his authorized representative.

The displayed prices for the products are net prices, so they do NOT include the statutory 27% VAT. The total amount plus VAT can be seen in the basket on the website, and it will be indicated separately when finalizing the order. Prices do not include home delivery.

If the Service Provider displays an incorrect price next to the product, despite the care expected of it, and the price of the product differs from its generally accepted price, the Service Provider is not obliged to supply the product at the incorrect price, but is obliged to offer the customer the real price in the confirmation of the order the possibility of purchasing at a price. If the buyer does not wish to use this option, he has the right to unilaterally withdraw from the contract.

In our online store, you can browse the products and services available for purchase by product category. In addition to the listed products, you can view a brief description, price, and other features of each product, without the need for completeness. If you want to get more information about the product, click on the image or name of the product. You will then be taken to the product page, where you can get more detailed information about the product. If you need more detailed information, please contact the Service Provider at the telephone number recorded in the Service Provider data.


Order process

- 1. By clicking the "Add to Cart" icon, you can place the product in the Cart. You can add products to the Cart without logging in, but you must log in before placing an order. You can only do this if you register. You can find the registration under the following menu item. If you are a registered customer but have forgotten your password, use the “Forgot password” reminder. If you enter your registered e-mail address here, we will send you your password by e-mail. You can log in using the "Login" menu item. Enter your registered e-mail address and password here, then press the Login button. If the login is successful, this window will display your registered e-mail address and the Exit button, which you can use to leave the store.

- 2. You can check and edit the contents of the basket using the Basket menu item. It is possible to view and modify the quantity of the product in the basket that you wish to order, as well as to choose the payment and delivery method that suits you best, or to delete the item. It is also possible to completely empty the basket. If you want to add another product to the cart, select the "Continue shopping" button. If everything is in order and you have decided on the order, you can finalize your order by pressing the "Checkout" button.

- 3. After finalizing ren 

we will send you an automatic confirmation containing the details of your order to the e-mail address you provided. If you do not receive such a letter, the system has not accepted your order. In such a case, please contact us, as already indicated, using the Service Provider data.

After we have completed the processing of your order, we will send you an Order Closed confirmation to the e-mail address you provided. The product will only be delivered after this.

You can monitor the progress of your order until the order is closed using the Order tracking menu item. Here you can also find all the orders you have sent to our online store so far. Each order can be identified by a unique order number.


4. Registration

If you want to make a purchase, you must also enter the data required for the purchase during the first purchase, such as your name, billing and delivery data, e-mail address, and your password for subsequent access. Before finalizing the registration, it is also necessary to accept the registration conditions. The system will confirm the registration by e-mail. The customer is obliged to keep the password he provides confidential. If the customer's unique identifier and password were correctly entered during the identification, the customer's data fell into the possession of an unauthorized third party, the Data Controller does not assume responsibility for the resulting damages or disadvantages. By entering their e-mail address, users consent to the Service Provider sending them technical messages. The Service Provider deletes the registered data from the system upon request. For security reasons, the deletion request will only be valid if the deletion request is confirmed by the user by e-mail, so that it can be avoided that someone intentionally or mistakenly deletes something else from the registration database. Registration is identified by the e-mail address, so an e-mail address can only be registered once.

Registration does not entail any obligations.


5. Processing of orders

Orders are processed on working days between 8:00 a.m. and 5:00 p.m. It is also possible to place an order outside of the times marked as processing the order, but if it is done after the end of working hours, the order will only be processed on the following working day. The deadline for the fulfillment of the accepted order is 1-2 working days for products in stock from the confirmation. If the product is not in stock, it takes 2-20 working days depending on the place of purchase.

Our company is not responsible for any changes to the technical specifications of the ordered product without prior notification due to reasons beyond the supplier's control.


6. Method of payment for the price of the ordered product and the home delivery fee

Cash on delivery

If you wish to settle the value of the order upon receipt of the package, select the "cash on delivery upon delivery" payment method. In this case, you can pay the courier in cash when you receive the package. In the case of payment by cash on delivery, the ordered product must be paid in cash to the delivery person upon receipt of the package.

The final amount to be paid includes all costs based on the summary of the order and the confirmation letter. The package includes the invoice and the necessary guarantee letter. Upon delivery, please inspect the package before the delivery person, and in case of damage or missing products, ask for a report and do not accept the package. We are unable to accept subsequent complaints without a protocol.

Cash

If you wish to pay the value of the order in cash, select the "Cash payment upon personal collection" payment method. In this case, you can pay in cash at our office when you receive the package. Our office address: 6000 Kecskemét, Ciklámen u. 14.

Credit card payment

Payment by credit card: If you wish to pay the value of the order by credit card, select the "Payment by credit card" payment method. In this case, the total amount of the invoice is settled using the SimplePay service, where you can pay by bank card (VISA, MasterCard, American Express). Online bank card payments are made through Barion's system. The bank card data will not reach the merchant. Barion Payment Zrt., which provides the service, is an institution under the supervision of the Magyar Nemzeti Bank, license number: H-EN-I-1064/2013.

Bank Transfer

You can pay for your order by bank transfer. When ordering, we will send you an electronic fee request invoice, on which you will find the data required for the transfer, the fee requester's number, and the order number, which must be indicated in the notification column. Acceptance and delivery of the products is possible after the financial payment has been processed, and we will inform you of its completion by e-mail. As our partner, the payment deadline 

it can be 1-7-14-30 days.

Ownership

The Service Provider retains ownership of the delivered goods until the obligations arising from the contract with the Customer are fulfilled. If this retention of ownership is not possible based on the legal provisions in force at the Customer's place of business, the Customer must expressly draw the Service Provider's attention to this. In this case, the Buyer is obliged to provide the Service Provider with a guarantee equivalent to the delivered goods. As an alternative, the Service Provider may request payment in advance.


Home delivery rates

The delivery fee of the GLS courier service within 24 hours is the fee indicated in the webshop for delivery up to 15 kg, which is indicated on the invoice issued after the order. In the case of packages over 15 kg, we will always contact the customer to clarify the delivery fee. In some cases - in the case of purchases over a certain amount, during the promotion period, with the use of a coupon - the delivery fee is waived.

7. Delivery deadline

Our in-stock products are delivered to your home within 24 hours on working days if the order is received between 8:00 a.m. and 4:00 p.m. In other cases, the delivery time is 2-5 working days, in some cases longer delivery times may occur for import packages, we will always inform our partners about the expected delivery time.

8. Home delivery information

Orders received by our online store are delivered exclusively by couriers of the GLS Hungary Kft. courier service. Packages are delivered on working days between 8:00 a.m. and 5:00 p.m. As a delivery address, it is advisable to enter an address where the courier can be received continuously during the time of day indicated, and where they can ensure the payment of the value of the shipment and the delivery fee, as well as the cash on delivery fee, to the courier.

Only order the desired products if you can pay the courier the fee when you receive the package. In the case of returned packages that have not been received, we will charge the customer the cost of shipping and return shipping, and we will only be able to resend the package if the consideration for the package is settled in advance.

9. Right of withdrawal

45/2014 on contracts concluded between absentees. according to the regulations of the government decree, the provisions of this point can only be applied to the customer who is considered a consumer. Within 14 working days of receiving the ordered product, the consumer may withdraw from the contract without giving a reason, or return the ordered, unopened product. If the consumer exercises his right of withdrawal, he must communicate this to the Service Provider in a clear written statement (by registered mail with return receipt or by e-mail). After receiving the withdrawal statement, the Service Provider is obliged to confirm it to the consumer immediately. In case of cancellation, the consumer must return the ordered product to the Service Provider within 14 days of the notification of cancellation. The cost of the return is borne by the consumer.

If the consumer exercises his right of withdrawal, within 14 days after receiving the relevant statement, the Service Provider is obliged to refund the payments he made to the consumer, including the delivery fee. The exception to this is if the consumer has chosen a mode of transport that incurs additional costs and is different from normal transport. The Service Provider does not have to fulfill its repayment obligation until the supplied product has been returned, or until the consumer has received creditworthy proof of the return of the product. In the event of a discrepancy between the two dates, the Service Provider must take the earlier date into account.

The Service Provider may demand compensation from the consumer for material damage resulting from improper use. Therefore, pay particular attention to the intended use of the product, as the consumer is responsible for compensation for damages resulting from improper use.

After the package arrives at our company, the opening of the package and the examination of the returned product are recorded with a video camera. This is necessary to avoid possible misunderstandings later on. (for example, that the returned product was damaged or incomplete)

The consumer is not entitled to the right of withdrawal:

in the case of a product whose price depends on financial market movements and fluctuations that cannot be controlled by the company

in the case of a non-pre-manufactured product, which was produced specifically at the request of the consumer, in accordance with his individual request based on the needs set by him

in the case of a product for which the Service Provider complies with the express request of the consumer for urgent repair or maintenance work 

11. Warranty

Regarding its products, the Service Provider undertakes a guarantee (guarantee) of the duration indicated in the information on the Website, under the conditions specified in the relevant warranty conditions. The Service Provider shall notify the duration of the warranty for each product at the latest by means of the data on the warranty card (warranty card) given when the product is received by the Customer.
From the date of performance by the Service Provider (the date of handover or commissioning) the Customer may assert his rights related to the warranty during the warranty period.

The Customer is only entitled to assert his warranty rights by presenting or handing over the warranty card provided by the Service Provider upon receipt of the product, or the invoice issued as proof of payment. The Customer must prove the fact of the purchase beyond any doubt. In all cases, the scope of the warranty rights for individual products is governed by the provisions of the warranty certificate.

During the warranty period, the Service Provider undertakes to replace or repair the defective product at the Customer's choice, as provided in the warranty certificate, unless the repair or replacement is not possible, or it would result in disproportionate additional costs for the Service Provider compared to fulfilling the other warranty claim. If the repair or replacement is not possible, or the Service Provider has not undertaken it, the Customer may, according to his choice, demand an appropriate price reduction or withdraw from the contract, if all this is allowed by the commitments in the warranty certificate. There is no room for cancellation due to an insignificant error.

If, due to a malfunction of the product, the Customer requests a replacement within three working days of the delivery of the product, the Service Provider is obliged to replace the product, provided that the malfunction prevents the intended use.

The warranty obligation does not apply to defects that occurred after completion. The Service Provider is responsible for proving this. The warranty does not affect the Customer's statutory warranty rights. The Customer can find out about the place of repair on the warranty card of the given product or at the Service Provider's customer service.

In other respects, the warranty is governed by §§ 6.171-173 of the Civil Code.


12. Dealing with complaints

The Service Provider is obliged to record the complaint, in the place indicated in the Service Provider's data, and to keep the complaint, together with the response, for five years from the date of recording. The Service Provider examines the complaint received within 30 days of its receipt and must provide a meaningful response. If the Service Provider gives a negative response to a complaint, it must give reasons in writing. Legal disputes arising from the Service Provider's contract can primarily be handled amicably, by agreement between the parties, or before the competent consumer protection authority according to the consumer's place of residence. If these do not lead to a result, the parties will have to go to court.

13. Data management

The Service Provider treats the personal data provided during the use of the online store as confidential and does not disclose it to third parties, except in the case of its subcontractor. (Ex: courier service, invoicing systems), this is necessary to deliver the order.

The parties declare that the current data protection legislation is binding on them

available on the Parties' public websites. Further information on data management

During browsing of the online store, technical information is recorded for statistical purposes. (IP address, duration of visit, etc.). The Service Provider will only hand over this data to the authorities in legally justified and substantiated cases. Cookies must be enabled to use the service. If you do not want to allow the use of cookies, you can disable them in your browser settings. If cookies are disabled, the service is certain 

its elements can only be used partially or not at all. A cookie is a file that the server sends to the user's browser and that is stored on the user's computer. No personal data is stored in the cookie. The Service Provider uses the data recorded during the order to fulfill the order. The data of the invoice created by the individual IT systems from the order placed on the pages of the online store is recorded with the data provided during the order placement and stored for the period specified in the accounting law in force. The Service Provider treats the data provided during the browsing of the online store or when subscribing to the newsletter provided during registration as confidential, unsubscribing can be requested at one of the contact details provided. You can request the deletion or modification of your data at any time in writing. .

During the procedure starting with the order, CXII of 2011. the provisions of the Act govern, the Service Provider's data protection statement is available on the website.

14. Other provisions

In matters not regulated in these general terms and conditions, the Civil Code (Act V of 2013) and, in the case of consumer contracts, Act No. 45/2014 on absentee contracts. the provisions of the government decree are governing.

15. Copyright protection

The texts, images and videos on the website are protected by copyright!

The website www.bartools.hu and ZBS Kft. have trademark rights, and their use is only permitted with the written consent of the Service Provider, unless it is included as a reference. The User acknowledges that the Service Provider is entitled to charge a penalty in case of unauthorized use. The amount of the penalty is HUF 60,000 gross per image, and HUF 20,000 gross per word. The User acknowledges that this amount is not excessive and uses the site in this way. If the Service Provider infringes copyright rights, it will use the fact certificate issued by the notary and charge the amount to the infringing User.
